1. DEFINITIONS

“Instructor”: Any individual registering on the TrainYou platform for delivering training or seeking training engagements. This includes independent professionals, subject matter experts, and trainers.
"TrainYou", "we", "our", "us": Refers to Rajmanmahi Solutions Pvt. Ltd., owner and operator of the TrainYou application, responsible for the platform’s administration, maintenance, and compliance obligations.
“Training Provider”, “Institute”, “Vendor”: Any organization, institute, or entity that posts training requirements or seeks to engage instructors via the platform, including corporates and training agencies operating globally.
"Personal Information": All data provided by the Instructor, including names, contact details, audio/video introductions, qualifications, past experience, certifications, and any other information collected or generated in connection with the use of TrainYou.

2. ACCEPTANCE OF TERMS

By clicking “Accept,” creating an account, or otherwise using the TrainYou platform, you irrevocably agree to be bound by these Terms and Conditions (“Agreement”), the Privacy Policy, and all other related policies and guidelines, as they may be amended from time to time. If you disagree with any provisions, you must neither register nor use TrainYou.

3. SCOPE OF SERVICES

3.1. Profile Creation and Data Submission:

Instructors are obligated to submit true, accurate, and current professional and personal information, including multimedia introductions. Providing incomplete, false, or misleading data is grounds for suspension or termination.

3.2. Access to Opportunities:

You, as an Instructor, may:

Host and list your own training programs or sessions on the platform where other trainers can also grab this opportunity.
View and apply for training opportunities posted by other users, including Training Providers, Institutes, or Vendors.
Receive automated and/or curated recommendations for relevant training sessions based on profile data for optimized engagement and visibility.

3.3. Profile Visibility:

Your profile, including selected Personal Information, may be visible to other authorized users and vendors to facilitate suitable matching between instructors and training opportunities.

4. DATA USAGE, PRIVACY, AND SECURITY

4.1. Purpose of Data Collection and Use:

To improve service delivery and user matchmaking.

For compliance with legal or regulatory obligations.

For internal analytics, operational security, and workflow optimization.

For communication related to opportunities, platform updates, and support.

4.2. Non-Disclosure of Personal Information:

Personal Information will never be sold or transferred to unauthorized third parties without explicit, written Instructor consent.

Disclosure of data is strictly limited to use cases such as technical support, data analysis, system validation, or as required by law. All third-party service providers must adhere to strict confidentiality obligations.

4.3. Retention and Deletion:

Information is retained only as long as necessary for providing services or as required by applicable law.

Upon written request or termination, your data will be securely deleted or anonymized, except where retention is mandated by law or for legitimate business needs (e.g., resolving disputes, audit requirements).

4.4. Security Standards:

Use of industry-standard encryption for data at rest and in transit.

Role-based access controls and regular security audits.

Prompt investigation and remediation of any data breach or unauthorized access.

5. USER CONDUCT AND OBLIGATIONS

5.1. Instructors' Obligations:

Submit only accurate, up-to-date, and lawful information.

Use the platform solely for professional training and engagement purposes.

Not infringing upon the intellectual property, privacy, or security rights of others.

Immediately notify TrainYou of any unauthorized use of your account.

5.2. Profile Management:

Instructors may update, correct, or delete their profile and Personal Information by contacting TrainYou or using in-app tools, subject to retention clauses outlined above.

5.3. Prohibited Activities:

No use of the platform for spamming, fraudulent activity, or dissemination of malicious content.

No posting of irrelevant or misleading training offers, requests, or communication.

6. ADMINISTRATIVE RIGHTS

6.1. Platform Oversight:

TrainYou reserves the unrestricted right, at its sole discretion, to monitor, review, and remove any user, profile, training request, or communication that violates these Terms or the intended use of the platform, without prior notice.

This includes, but is not limited to, flagging, restricting, or deleting data, and terminating access for non-compliance, ambiguity, irrelevance, or misconduct.

6.2. Monitoring:

All activities, including chat functionality, may be subject to periodic moderation to ensure quality, security, and compliance with laws and policies.

Monitoring is conducted with due regard to user privacy and only for maintaining platform integrity.

7. LIMITATION OF LIABILITY AND INDEMNITY

7.1. Limitation of Liability:

TrainYou is not responsible for any loss, damage, or liability arising from unauthorized data sharing by users, incorrect profile information, or misuse of the platform by any party.

TrainYou does not guarantee uninterrupted access, error-free operation, or the selection of any Instructor for specific opportunities.

7.2. Indemnification:

The Instructor agrees to indemnify and hold harmless TrainYou, its affiliates, employees, and partners from any losses, liabilities, claims, damages, or expenses, including reasonable legal costs, arising directly or indirectly from the Instructor’s breach of these Terms or the Privacy Policy.

8. MODIFICATION OF TERMS

TrainYou reserves the right to modify or replace these Terms at any time. Material changes will be communicated via email or in-app notification. Your continued use of the platform post-change constitutes express acceptance of the revised Terms.

9. GOVERNING LAW AND JURISDICTION

This Agreement and any dispute or claim arising from it are governed by the laws of India. The courts of New Delhi have exclusive jurisdiction in any proceedings related to these Terms.
